Continuing the Civil and Commercial Law series, the Faculty of Law at Van Lang University organized Seminar No. 03, "Intellectual Property Agreement Provisions in Civil and Commercial Contracts - Keynotes for Drafting and Negotiation," on June 8, 2024, at Hall N2T1, Main Campus. This event aimed to enhance legal knowledge and provide opportunities for students and postgraduates to access international law.

Assoc. Prof. Dr. Bui Anh Thuy, Dean of the Faculty of Law, VLU, remarked, “Intellectual property is closely related to civil issues and commercial relationships, ensuring the rights of parties when entering into agreements. Within the Civil and Commercial Law series framework, this seminar offers valuable insights into intellectual property law in Vietnam and international contexts, benefiting our law students and the research community.

Assoc. Prof. Dr. Bui Anh Thuy hopes that the Civil and Commercial Law series will provide meaningful opportunities for knowledge exchange and experience sharing for the passionate research community.

Led by Dr. Nguyen Ho Bich Hang, a Postdoctoral Researcher at the University of Eastern Finland, Seminar No. 03 attracted over 200 lecturers, postgraduates, and undergraduates both from within and outside the law field. Dr. Nguyen Ho Bich Hang started the seminar by introducing practical aspects of intellectual property protection in Vietnam, providing an overview of intellectual property rights in civil and commercial contracts, and emphasizing the urgent need to protect these rights.

Dr. Nguyen Ho Bich Hang shared with the VLU community on the topic "Intellectual Property Agreement Provisions in Civil and Commercial Contracts - Keynotes for Drafting and Negotiation."

Discussing the intellectual property provisions in contracts, Dr. Bich Hang clarified Vietnamese legal regulations and connected them to practices in various other countries. She also suggested solutions to overcome certain obstacles in enforcing intellectual property rights. Dr. Bich Hang highlighted key points in drafting and negotiating terms related to co-ownership, co-authorship, and non-compete agreements. Specifically, she emphasized that identifying the contracting parties is crucial, and the transfer of rights must be supported by documented evidence. The valuation of intellectual property should consider its commercial potential and the benefits for both the buyer and the seller. Importantly, Dr. Bich Hang highlighted the significance of non-compete clauses in contracts, especially arrangements regarding the obligation to protect trade secrets and the associated financial arrangements, which play a crucial role.

The topic of intellectual property garnered interest from many students, leading to a lively discussion during the seminar.

Within the topic of intellectual property in civil and commercial contracts, participants eagerly asked questions and debated current issues such as intellectual property infringement in fashion design and video games. Alongside the two seminars on “Tort Law in the US” and “Overlap in Protecting IP Rights - Impacts on Innovation and Competition” held in May 2024, the seminar on “Intellectual Property Agreement Provisions in Civil and Commercial Contracts - Keynotes for Drafting and Negotiation” has further enriched the attendees' knowledge of Civil and Commercial Law. With participation from experts in the legal field, who are teaching and researching at international institutions, the series has created an academic exchange space, sparking new discussions and providing Van Lang University law students with valuable insights.
